Agreement to these terms

These Terms of Service are an agreement between you and `[LEGAL ENTITY NAME]` (“GymSync,” “we,” “us,” or “our”). By creating an account or using GymSync, you agree to these Terms and our Community Guidelines. If you do not agree, do not use the service.

Eligibility

You must be at least `[18]`, legally able to enter this agreement, and permitted to use GymSync under applicable law. GymSync is intended for adults. Add any region-specific age or eligibility rules before launch.

Your account

Provide accurate information, keep your credentials secure, and promptly update information that changes. You are responsible for activity through your account. Do not share, sell, transfer, or create an account for someone else.

Acceptable use

You may use GymSync only for lawful, genuine fitness-connection purposes and in accordance with our Community Guidelines. You may not:

- Impersonate others or misrepresent identity, intentions, qualifications, or affiliations

- Harass, threaten, stalk, discriminate against, exploit, or harm another person

- Post unlawful, infringing, deceptive, sexually explicit, or dangerous content

- Scam, spam, solicit money, or sell regulated goods or services

- Scrape data, automate interactions, distribute malware, reverse engineer protected elements, disrupt the service, or evade enforcement

- Use GymSync or AI features to create or facilitate prohibited content or conduct

Member content

You retain ownership of content you submit. You grant GymSync a `[SCOPE]`, `[DURATION]`, worldwide licence to host, store, reproduce, modify for technical formatting, display, distribute, and otherwise process that content as needed to operate, improve, secure, and promote the service according to your settings and this agreement.

You confirm that you have the rights needed to submit your content and that it does not violate law or another person’s rights. Counsel must finalize the licence scope, promotional use, sublicensing, survival, and deletion treatment.

Matching, communication, and in-person activity

Profiles contain information supplied by members. Suggestions, compatibility indicators, and AI output do not guarantee identity, qualifications, intentions, attendance, compatibility, results, or safety.

You decide whether and how to communicate or meet. Use independent judgment, meet in public, respect facility rules and physical limits, and seek qualified professional advice where appropriate. GymSync is not a gym, healthcare provider, emergency service, background-check provider, or credentialing body unless a specific feature expressly states otherwise.

Pulse and AI output

Pulse may generate profile, conversation, planning, or other suggestions. AI output may be incomplete, inaccurate, or inappropriate. It is not medical, legal, nutritional, coaching, or other professional advice. You are responsible for reviewing output before using or sharing it.

Reports and enforcement

GymSync may review content and account activity, investigate reports, remove content, limit features, warn members, suspend accounts, or permanently terminate access. We may take action for serious off-platform conduct connected to GymSync when it creates risk for members or the service.

To request review of an enforcement decision, email `safety@gymsync.ai` from the address associated with your account. GymSync may preserve information where reasonably necessary for safety, enforcement, fraud prevention, disputes, or legal compliance.

Fees and subscriptions

Insert the approved commercial terms before enabling payment: `[PRICE, BILLING PERIOD, AUTO-RENEWAL, TRIAL, CANCELLATION, REFUND, TAX, AND APP-STORE TERMS]`.

If GymSync is free at launch, state that some features may be introduced or changed in the future and that pricing will be disclosed before a charge is made.

Third-party services

GymSync may link to or integrate with third-party services. Their terms and privacy practices apply to their services. GymSync is not responsible for third-party services except where applicable law requires otherwise.

Intellectual property

GymSync and its licensors own the service, software, branding, designs, and other materials excluding member content. These Terms do not grant rights to use GymSync names, logos, or protected materials except as needed to use the service.

Service changes and termination

We may modify, suspend, or discontinue features and may terminate or restrict access as described in these Terms. You may stop using GymSync and delete your account at any time, subject to the production account-deletion process.

Disclaimers

GymSync is provided on an “as is” and “as available” basis to the extent permitted by law. We do not promise uninterrupted operation, particular fitness results, successful matches, member conduct, or the accuracy of member-provided or AI-generated information. Final language must preserve consumer rights that cannot legally be excluded.

Limitation of liability

Counsel must draft the limitation of liability, exclusions, cap, indemnity, and jurisdiction-specific consumer carve-outs based on the legal entity, launch markets, and risk model: `[COUNSEL-DRAFTED LANGUAGE]`.

Governing law and disputes

Insert the approved governing law, venue, informal resolution process, arbitration terms if appropriate, class-action language if enforceable, and consumer-rights exceptions: `[DISPUTE TERMS]`.

Changes to these terms

We may update these Terms. We will post the revised version and update the effective date. Where required, we will provide additional notice or request renewed acceptance.
